The Made-to-order purchase of any products from ILSA RUSS Morgenmäntel is governed by these terms and conditions. (Translation: “Morgenmäntel” is the German word for “Dressing Gowns”)
Intellectual Property and Right to Use
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in the designer ILSA RUSS.
You acknowledge and agree that the material and content contained within the website is made available for your personal non-commercial use only. Any other use of the material and content of the website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
Limitation of Liability
While we will use reasonable endeavours to verify the accuracy of any information we place on the website, we make no warranties, whether express or implied in relation to its accuracy.
We make no warranty that the Website will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy or reliability of the materials. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products. This does not affect your statutory rights as a consumer.

Personal information you submit, such as your name and address, is saved and used to fulfil your orders and provide customer service. In case you allowed us to, we are going to provide you with information on new products or news relating to ILSA RUSS Morgenmäntel.
We do not share your personal data with any third party for their marketing purposes.
We make all reasonable efforts to safeguard the security of your personal data. However, please be aware that we cannot guarantee the security of any data submission done over the internet.

We accept no responsibility for web sites or other information, practices or products of other parties linked to the website. Your dealings with persons found via the website are between you and such persons and we will not be liable for any loss or damage arising out of such dealings.
Placing of orders / Contract Information
Products ordered from the website are supplied by ILSA RUSS Morgenmäntel.
Your submission of an order represents an offer to purchase the products indicated by you and it is not binding on us until we have notified you that an order has been accepted. If products are shown on the site but are not available or are incorrectly priced or otherwise incorrectly described, ILSA RUSS Morgenmäntel shall not be obliged to sell you those products.
If you wish to order a style, your order is subject to the following conditions:
The customer places an order for items that will be made individually for each customer. Orders for all styles as shown in “COLLECTION” can be done via the order form. When filling in the order form it is important, that you specify your size by checking your measurements using our size chart. Please take a close look at the measurements for the different sizes at our international size chart.
Bigger sizes can be ordered on request. The standard body height of 1,70m is the base for our size chart. Please let us know, if you are more than 10cm bigger or smaller. In that case we offer to adjust the ordered style to your personal body height.
In case the information (E-Mail) about the sending of the order does not reach the customer, it is up to the customer to ask for the sending details. Missing informations about the arrival of the ordered items is no reason to chancel the purchase.
Payment
The transmitted address must be the billing / delivery – address.
As soon as your order is transmitted, you will receive the confirmation of order and the invoice.
The customer is obliged to check the order confirmation.
We ask you kindley to remit the balance to the account indicated.
After receipt of payment your order will be manufactured.
All prices shown in the website are including 19% tax.
The invoice shows the net price, the cost for packaging & delivery and the tax.
Please let us know via E-mail, if you need an invoice without tax.
Payment can be made by:
Bank transfer or PayPal.
Please allow up to 2-6 weeks after receipt of payment for delivery to be dispatched.
It is possible that – even though you receive the order confirmation and the invoice – a certain type of fabric is not available anymore. In this case we will contact you via E-Mail and ask you not to pay the invoice.
Customs & Duty
Please note that all shipments outside Germany may be subject to import duties and taxes, which are levied once a shipment reaches your country.
As we have no control over these charges and cannot predict what they may be, additional charges for customs clearance must be borne by you.
Delivery
Delivery of the order is done after having received the payment of the order.
In case delivery is refused by the customer, the customer is obliged to pay for the following delivery. In this case it is up to ILSA RUSS Morgenmäntel to cancel the purchase and ask for compensation.
Right of Withdrawal
Placed orders cannot be cancelled after the manufacturing of the order has started.
An exclusive “made-to-order” item means specifically manufactured to meet the customer’s requirements. Please note that all our styles are individually made for you (made-to-order) and therefore cannot be returned or refunded.
In case of legitimate claim, simply enter a few details to email us your questions, queries, complaints. We always listen and promise to do everything we can to improve our performance.
Care instruction
Enclosed to the parcel the customer will find the care instruction. No warranty can be given for improper care of the ordered item.
Notice of “Damage in transit or loss in transit”
In case of damage or loss in transit the customer is obliged to report immediately the damage or loss to the carrier and to ILSA RUSS Morgenmäntel and to help us with the enforcement of the claim against the carrier. The customer is obliged to keep the damaged parcel as proof of evidence. In case the damage or loss is not seen from the outside the customer is obliged to report the damage or loss to the carrier and to ILSA RUSS Morgenmäntel within 7 days time.
Returns & Refunds
We hope you love your purchase or gift and are completely happy with it. If not, please take note of our returns policy below to avoid any possible disappointment.
An exclusive “made-to-order” item means your order will be specifically
manufactured to meet your requirements. Please note that all our styles are individually manufactured and therefore cannot be returned or refunded.
Severance
If any part of the conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these conditions and shall not affect the validity and enforceability of any of the remaining provisions of the conditions.
Each provision of these conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.
Law
The Conditions shall be governed by and construed in accordance with the laws of Germany and you irrevocably submit to the exclusive jurisdiction of the courts of Germany.
Entire Agreement
These Conditions (as amended from time to time) contain the entire agreement between the customer and us relating to the subject matter covered and supersedes any previous agreements, arrangements, undertakings, representations or proposals, written or oral, between you and us in relation to such matters. You confirm that you have read these conditions and, you fully understand them and you also agree that these conditions are the only terms (together with your network provider agreement) that rule your relationship with us.
